1. Who we are

These terms govern your use of allenshop.site and the purchase of services from Allen Shop LLC, a limited liability company located at 325 West John Street, Martinsburg, WV 25401, United States ("Allen Shop", "we", "us"). By engaging our services or using this site, you agree to these terms.

2. Services

Allen Shop provides digital commerce and advertising services, including store design and development, 3D and interactive web experiences, performance and SEO work, conversion optimization, systems integration, and growth and retention services. The specific scope, deliverables, timeline, and fees for any engagement are defined in a written proposal, statement of work, or order confirmation agreed with the client (the "Engagement").

3. Service delivery

Services are delivered digitally. Deliverables and timelines are stated in each Engagement. Unless otherwise agreed, work begins after the Engagement is confirmed and any agreed initial payment is received, and deliverables are provided electronically (repository access, file transfer, or deployment to client systems).

4. Fees and payment

• Fees are quoted in U.S. dollars and stated in each Engagement.
• Unless otherwise agreed, projects are billed with an initial deposit and milestone or completion payments.
• Invoices are due within the period stated on the invoice.
• Payments are processed by third-party payment processors; we never store card details.

Charges will appear on your statement as ALLEN SHOP.

5. Cancellations and refunds

Cancellation and refund rights are described in our Refund & Cancellation Policy, which forms part of these terms.

6. Client responsibilities

Clients agree to provide timely access to the materials, accounts, and approvals reasonably needed to perform the Engagement, and warrant that materials they supply do not infringe third-party rights.

7. Intellectual property

Upon full payment, deliverables created specifically for the client under an Engagement are assigned to the client, except for pre-existing tools, libraries, and know-how of Allen Shop, which are licensed to the client for use within the deliverables. Third-party and open-source components remain governed by their own licenses.

8. Warranties and liability

Services are provided with reasonable skill and care. Except as expressly stated, services are provided "as is" and we disclaim implied warranties to the extent permitted by law. To the maximum extent permitted by law, our total liability arising from an Engagement is limited to the fees paid for that Engagement, and neither party is liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited by law.

9. Governing law

These terms are governed by the laws of the State of West Virginia, United States, and disputes are subject to the courts located in Berkeley County, West Virginia, unless applicable law provides otherwise.
